In the High Court of Justice, Zamfara State, Nigeria, in the Gusau Judicial Division, convened at High Court VII Gusau on Monday, 295 November 2023, before the esteemed Honorable Justice Bello Muhammad Kucheri, a case was heard bearing the reference number ZMS/GS/M.281/2023 between Alh. Waisu Musa as the applicant and Hon. Kabibu Ahmadu (AKA Mai Palace) as the respondent, represented by M.R.D Labaran for the Applicant and Umar Asho for the Respondent/Judgment Debtor.
The court, having reviewed the application and accompanying affidavits presented by the applicant’s counsel, as well as the written address accompanying the application, noted the absence of objections from the respondent. Consequently, the court found merit in Prayers No.1 and 2 of the application, thereby granting leave to the applicant to seek a Writ of Execution upon the immovable property of the Judgment Debtor in Suit No: ZMS/GS/78/2022 for recovery purposes.
In Suit No: ZMS/GS/78/2022 between Alh. Ahmad Musa (A.A. Master) and Hon. Kabiru Ahmadu (AKA Mai Palace), final judgment was rendered in favor of the plaintiff on 22nd February 2023. The judgment ordered the defendant to pay the plaintiff a sum of N10,000,000, which was a cheque received and credited into the defendant’s account from the plaintiff. Additionally, the defendant was mandated to pay general damages of N2,000,000 for breach of contract and a further sum of N500,000 as litigation costs.
However, the court refrained from ordering any interest payment as it was not applied for by the plaintiff. A certified true copy of the judgment was issued, detailing the particulars of the case, signed by Hon. Justice Muhammad Bello Kucheri and certified by Rabiu Sani, Principal Registrar I.
Moreover, the court granted the judgment sum of N12,500,000 as the judgment debt in Suit No: ZMS/GS/2022. Nonetheless, Prayer No.3 for additional relief was declined due to full representation of the Judgment Debtor, prompting the court to instruct the Judgment Debtor’s counsel to be served accordingly.
