The Court of Appeal has overturned the prior ruling by the Lokoja High Court in a contempt case involving Kogi State Governor, Yahaya Bello, and the Economic and Financial Crimes Commission (EFCC), along with its Chairman, Ola Olukoyede.
Presided over by Justice Joseph O.K. Oyewole, the Court of Appeal granted a motion filed by the EFCC for a stay of execution and proceedings in the contempt case, currently before the Kogi State High Court. This decision effectively puts a pause on the contempt proceedings against the EFCC and its chairman, allowing for a thorough review of the case.
The court found merit in the EFCC’s motion ex parte and scheduled the hearing of the motion on notice for May 20, 2024. Additionally, it ordered that all legal documents related to the case be served through substituted service at Yahaya Bello’s last known address in Abuja.
This ruling marks a pivotal moment, as it not only halts the ongoing contempt proceedings but also green-lights the appeal filed by the EFCC against the Lokoja High Court’s initial ruling. The case, titled EFCC vs. Alhaji Yahaya Bello, bears the Appeal No: CA/ABJ/CV/413/2024.
