Murja Kunya Takes Kano Attorney General, HSMB, CP, to Court [PHOTO]

In a significant legal development, Murja Ibrahim Kunya has initiated legal action against several key figures in Kano State, including the Attorney General, the Commissioner of Police, the Kano State Hisbah Board, and the Kano State Hospital Management Board. This action stems from a recent court ruling at the High Court of Justice of Kano State, where Honorable Justice Nastru Saminu presided.

The court responded to a Motion Exparte dated February 26th, 2024, by granting various orders sought by Murja Ibrahim Kunya. Notable among these orders include:

1. An order for leave to apply for certiorari, aimed at removing the proceedings and orders of the presiding judge, Malam Nura Yusuf Ahmad, in the case number CR/762/24. This motion was filed due to allegations of lack of jurisdiction, fair hearing, abuse of court process, error on the face of the record, and bias.

2. An order directing the 2nd Respondent to issue and serve the Applicant’s Counsel with the Certified True Copy of the entire record of proceedings and facilities relied upon by the prosecution.

3. An order staying proceedings in Case No. CR/762/2024 between Commissioner of Police V. Murja Ibrahim Kunya, effectively putting a halt to the ongoing legal process.

4. An order directing the 4th and 5th Respondents to provide unrestricted access to Murja Ibrahim Kunya’s counsel.

The court’s decision, delivered after hearing arguments from the applicant’s representatives, granted prayers 1, 2, 4, and 5, while refusing prayers 3 and 6. However, the court instructed the applicant to notify the respondents regarding the refused prayers.

This legal matter has been adjourned to March 20th, 2024, for the hearing of the originating summons.
